Welcome to Ecuaa. The terms “we”, “us” and “our” refer to Ecuaa. Ecuaa operates this website and online store (the “Services”) to provide you, the customer, with access to our artisan products. Our Services are powered by Shopify.
These Terms of Service, govern your use of the Services, including browsing, ordering, and purchasing our products. Please read them carefully, as they contain important information about your rights and obligations as a consumer.
By accessing or using the Services, you agree to these Terms and our Privacy Policy found in Ecuaa's page footer . If you do not agree, please stop using our Services.
1. ACCESS AND ACCOUNT
To use the Services, you must be of legal age in your country of residence or have parental consent. You agree to provide accurate, complete and up-to-date information. You are responsible for maintaining the confidentiality of your account credentials and all activity under your account.
2. OUR PRODUCTS
We make every effort to present our products accurately. However, minor variations in color or appearance may occur due to screen or device differences. All product descriptions, prices, and availability are subject to change without notice. We may discontinue products or limit quantities at our discretion.
3. ORDERS AND CONTRACT FORMATION
When you place an order, you make an offer to purchase. A binding sales contract is formed once we confirm acceptance by email (order confirmation). We may refuse or cancel orders where there are errors, suspected fraud, or supply limitations.
Your order is subject to our Refund & Returns Policy found in Ecuaa's page footer. You agree that your purchases are for private use only, not for resale.
4. PRICES, TAXES, AND PAYMENT
Prices shown in our store are those in effect at the time of ordering. If applicable, EU VAT will be included in the displayed price and shown separately on your invoice. Prices exclude shipping and customs duties unless stated otherwise.
You agree to provide current and accurate billing details and authorize us (via Shopify Payments or PayPal) to charge your payment method for the order total.
5. SHIPPING AND DELIVERY
We ship from Ecuador to the rest of the world, returns are handled by region.
Estimated delivery times are indicative only. We are not liable for delays outside our control (carriers, customs). Risk of loss passes to you upon delivery to your address. We retain title to goods until full payment has been received.

To initiate a return, you must first contact us at info@ecuaa.store to receive a return authorization. Items sent back without prior authorization will not be accepted.

6. RIGHT OF WITHDRAWAL (EU/EEA CUSTOMERS)
If your order is delivered within the EU/EEA, you have a legal right to withdraw from the contract within 14 days without giving any reason. The withdrawal period ends 14 days after you (or someone you nominate) receives the goods.
To exercise this right, notify us at info@ecuaa.store. You must send the goods back within 14 days of informing us. Unless otherwise stated, you bear the cost of return shipping. Refunds (including standard outbound delivery costs) are made within 14 days to your original payment method.

7. EXTENDED RETURN POLICY (30 DAYS)
In addition to your statutory rights, we offer a 30-day goodwill return period. Conditions: items must be unused, in original packaging, with tags. This does not affect your legal rights.
8. LEGAL GUARANTEE OF CONFORMITY
EU consumers have a two-year legal guarantee that goods are free from lack of conformity. If an item is faulty or not as described, you are entitled to repair, replacement, or refund in accordance with EU law.
9. DAMAGES AND ISSUES
Please inspect your order upon delivery and contact us immediately if the item is defective, damaged, or incorrect.
10. INTELLECTUAL PROPERTY
All content on the Services (including trademarks, text, images, graphics, and layout) is owned by Ecuaa or licensors. You may not copy, reproduce, or distribute our content without prior written consent, except as permitted by law.
11. THIRD-PARTY TOOLS & LINKS
We may provide access to third-party tools or links. Use of these is at your own discretion and subject to the providers’ terms. We are not responsible for third-party content.
12. RELATIONSHIP WITH SHOPIFY
Our store is hosted by Shopify. Your contract is with Ecuaa, not Shopify. Shopify is not responsible for our products, sales, or services.
13. PRIVACY & DATA PROTECTION
Your personal data will be processed in accordance with our Privacy Policy and Shopify’s privacy terms, in line with the GDPR.
14. PROHIBITED USES
You agree not to misuse our Services (e.g., unlawful activity, introducing malware, scraping, or infringing rights). We may suspend or terminate your account for misuse.
15. DISCLAIMER & LIMITATION OF LIABILITY
Nothing in these Terms excludes or limits liability where unlawful, including liability for fraud, fraudulent misrepresentation, or death/personal injury caused by negligence.
To the extent permitted by law, we are not liable for:

losses not caused by our breach,

business losses (we supply only for private use),

losses not foreseeable at the time of contract.
Your statutory rights remain unaffected.
16. GOVERNING LAW & JURISDICTION
These Terms are governed by the laws of Ecuador, subject to any mandatory consumer protection laws of your country of residence.
EU/EEA consumers may bring claims in the courts of their habitual residence.

We may update these Terms from time to time. Changes take effect when posted on our website. For material changes, we will provide notice where required by law.
